Interpretation and Definitions

We use a lot of capitalized words in here, and they all have specific meanings that we've spelled out below. Whether they're singular or plural, they mean the same thing. So when we talk about these Terms and Conditions, here's what we mean: • Affiliate is any entity that controls, is controlled by, or works under the same parent company as one of the parties involved. • Country means Washington, United States. • Company refers to Activecanyon, or us, or we, or our. We're the chocolate service you're using. • Device is whatever you're reading this on—computer, phone, tablet, whatever gets you online. • Service is our website and the ordering system that runs it. • Terms and Conditions, or just Terms, is this whole agreement between you and us about how you use the Service. • Third-party Social Media Service means stuff other companies provide that shows up on our Service. • Website is Activecanyon. • You means the person using the Service, or the company or legal entity they're using it for.

Acknowledgment

This agreement covers everything about how you use the Service and is the complete deal between us. It lays out what everyone using this can and can't do. When you access or use the Service, you're agreeing to these Terms. You can't use the Service if you don't agree with them. That said, you're confirming you're at least 18 years old. We don't let anyone younger than that use what we offer. By using the Service, you're bound by these Terms. If any part doesn't work for you, you can't access the Service.

Links to Other Websites

Activecanyon might link out to third-party websites or services that aren't run by us. We don't control those sites and we're not responsible for what's on them—their content, privacy policies, how they operate, any of it. You understand that we're not liable for anything that happens because you use or trust content, products, or services from those other websites. That goes for both direct and indirect damage.

Termination

We can cut off your access without warning or explanation whenever we want, for any reason. If you break these Terms, that's an especially good reason. Once we terminate your access, you can't use the Service anymore.

Limitation of Liability

No matter what happens, our total liability and your only way to get compensation is capped at either what you actually spent with us or a hundred bucks if you haven't bought anything. Under the law as far as it allows, neither we nor our suppliers are responsible for special, incidental, indirect, or consequential damages. That includes lost profits, lost data, business interruption, injury, privacy breaches, or anything else tied to the Service not working the way it should or third-party software and hardware issues. This applies even if we knew this could happen and even if the remedy doesn't solve the original problem.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service comes to you exactly as it is, with every flaw included, and we're not making any promises about it. As much as the law lets us, we and our Affiliates and anyone who licenses or provides services to us are saying goodbye to all warranties. That's express warranties, implied warranties, statutory ones, everything. We're not saying the Service is fit to sell, fit for what you need it for, or free from anyone else's rights. More specifically, we're not claiming anything about how the Service runs, whether it's available, whether the stuff in it is accurate or up to date, or whether it's free from viruses and malware. The servers, the content, emails from us—none of that comes with any guarantee that it won't have problems.

Governing Law & Disputes Resolution

The laws of the Country, not including conflict of law rules, control these Terms and how you use the Service. Using Activecanyon might also fall under other laws depending on where you are. If something goes wrong or you're unhappy with the Service, we're asking you to contact us first and try to work it out informally before anything else.

Compliance & Regulations

For European Union users: If you're a consumer in the EU, you get the benefit of whatever mandatory consumer laws apply where you live. If you're in the United States: You're confirming you're not in a country under US embargo and not on any US government prohibited or restricted parties list.

Severability and Waiver

If a court finds that some part of these Terms doesn't hold up, we'll modify that part to make it work as much as the law allows, and everything else stays in effect. If we don't enforce something in these Terms, that doesn't mean we've given up the right to enforce it later. And if we let one breach slide, that doesn't mean we're okay with the next one.

Changes to These Terms and Conditions

We may have translated these Terms for you, but if there's ever a disagreement, the original English version is what counts. We can change these Terms whenever we want. If it's a big change, we'll give you about a month's notice before it takes effect. Keep using the Service after that and you're agreeing to the new version. These terms became effective August 5, 2026.
